Terms of service

These terms apply to the Degen Poet online store at www.degenpoet.com, operated under the Degen Poet name. Our store is hosted by Shopify. By using the store or placing an order, you agree to these terms to the extent a binding agreement is formed under applicable law. Our return and refund policy, shipping policy, and privacy policy explain additional terms and practices. Contact us through our contact page.

Orders, prices, and availability

You must be legally able to place an order or have appropriate authorization. Provide accurate contact, payment, and delivery information. Prices, available quantities, and product selections may change before purchase. Applicable shipping charges and taxes are shown at checkout. Adding an item to a cart does not reserve it. An order acknowledgment confirms receipt, not a guarantee that an unavailable item can be supplied.

We may decline or cancel an order for unavailable inventory, an obvious pricing or listing error, suspected fraud, or another lawful reason. We will notify you and refund any payment for an order we cancel. We will not substitute an artwork or increase an accepted price without your agreement. Nothing here permits us to withhold a refund owed to you.

Artworks, prints, and framing

Product descriptions identify whether you are purchasing an original, print, book, or framing service. Handmade work and paper may have natural variations. Screen settings and lighting can affect perceived colors. These variations do not excuse materially inaccurate descriptions or faulty goods.

Images labeled as mock-ups illustrate possible presentation. A displayed room, mat, or frame is not included unless the purchased option expressly includes it. Artist-selected framing uses a frame and mat chosen to complement the artwork; the final presentation may differ from a mock-up, subject to the product description and any agreed specifications.

Purchase of a physical artwork, print, or book transfers ownership of the physical item, not copyright, reproduction rights, commercial-use rights, or an NFT or other digital asset unless expressly stated. Intellectual-property rights remain with their respective holders. Do not reproduce, distribute, or commercially exploit protected content without the required permission or a legal exception.

Payments, delivery, and returns

Payments are processed through the options available at checkout and may be subject to the payment provider's terms. Where a blockchain payment option is selected, verify the network and transaction details shown by that provider. Blockchain transactions may be irreversible at the network level; this does not remove a refund or other remedy we owe under these policies or applicable law.

Preparation and delivery estimates are described in our shipping policy and product listings. Carrier transit time is additional to preparation time. If we cannot ship within the applicable promised period, we will provide the notice, consent, cancellation, or refund options required by law. Returns and cancellations are governed by our refund policy and mandatory consumer rights.

Responsible use and third parties

Do not misuse the store, attempt unauthorized access, interfere with its operation, submit fraudulent orders, or use it unlawfully. We may restrict access for misuse, subject to applicable law and existing customer obligations. Links to other websites are provided for convenience. We do not control third-party content or services; using them may be subject to separate terms and privacy practices.

Disclaimers and limits of liability

To the fullest extent permitted by applicable law, the website is provided on an as-available basis without a promise of uninterrupted or error-free access. We disclaim warranties only to the extent they can lawfully be disclaimed. Product descriptions, express promises, statutory guarantees, and mandatory consumer protections remain effective.

To the fullest extent permitted by law, Degen Poet is not liable for indirect or consequential losses, loss of profits, or business interruption arising from use of the store, and our total liability relating to a purchase is limited to the amount you paid for that purchase. These limits do not exclude or restrict liability that cannot lawfully be limited, including applicable liability for fraud, willful misconduct, gross negligence, death or personal injury, or infringement of mandatory consumer rights. Required refunds, replacements, and other statutory remedies remain available. If local law does not permit a limitation, it does not apply to you to that extent.

Changes, disputes, and general provisions

We may update these terms prospectively by posting a revised version and date. The terms applicable when you place an order continue to govern that order unless you agree otherwise or the law requires a change. An unenforceable provision is limited or severed without invalidating the remaining lawful provisions. No failure to enforce a provision waives future enforcement.

Please contact us first about a concern so we can try to resolve it. These terms do not require mandatory arbitration, waive a legally protected claim, or prevent you from using a court, regulator, or consumer dispute process available under applicable law.
